A recent case of Adams and another v Harwich International Port Limited ET/1503084/10 and 1503085/10 held that the Working Time Regulations 1998 which provide for annual leave can be read to mean that where a worker has been unable or unwilling to take his/her leave because of sickness then this leave can be carried forward to the next year. However, the Judge also made clear that this would not be able to continue indefinitely.
