On 9 August 2012 the Government published draft regulations for changes to the Companies Act 2006 relating to the registration of security created by companies and LLPs.
The principal changes being proposed are: the removal of criminal sanctions for failing to register a registerable charge; the assumption that all charges can be registered; changes to the information to be registered at Companies House and removing the need for companies to keep a register of charges.
These regulations are subject to comment by 7 September 2012.
